Terms and Conditions
By accepting to these terms you indicate that you also agree to the Minecraft End User License Agreement.
1) Data loss and protection.
While Germanode will attempt our best to retrieve any lost data, we will not be responsible if you lose any important any files or they become corrupt.
However, files covered with the “Backup Plan”, are guaranteed to be available even in case of a big hardware failure. The plan ensures that files get backed up once a day to a RAID6 Backup Server. Please contact support to access your backed up files. In the unlikely case of backup server failuire due to circumstances, that we do not controll, we are not responsible for the data that is saved there.
2) PayPal disputes and fraud.
The threat of opening a PayPal dispute or actually doing so will result in service termination. If you are unsure about anything happening to your service, please open a support ticket and talk to our team. If you deliberately charge back for no reason at all apart from getting free service, you will be unable to access the Germanode network and your service will be terminated.
3) Refund policy.
Minecraft server hosting plans include a 5-day money back guarantee if you think we did not deliver what we promised. After 5 days, you cannot get money back for your server.
To claim your refund, cancel your server within 5 days after purchasing and create a support ticket with an explanation which of our promises had been broken. If found that we broke a promise, we will refund you the amount you paid for the server space within 45 days after cancellation. Germanode guarantees to return the paid amount within this time period. Any transaction fees and Dedicated IP charges can not be refunded.
Germanode does not refund the money that has been added to the account for future use.
4) Protection of your server.
Our team is dedicated to fixing any issues you have with your server. Sometimes, we have to enter your console or files to fix any issues. We will ask for your consent first before entering unless it is a serious emergency and you are not available. Staff will contact you using a support ticket, E-mail or Discord.
5) What you can and can’t keep on your server.
5.a) You may only use your unlimited server space for server files. You may not use it as a file storing solution, please purchase that from the proper retailer.
If found abusing your storage, we will limit your space to 15GB, additionally, a file handling fee (4€) will apply in case your unallowed file size exceeds the 15GB limit.
Storage abuse automatically cancels the “Backup Plan” and your server files get removed from our backup servers. Money paid for the “Backup Plan” does not get refunded in that case.
You can use the limited 15GB space for anything except the types of files described in the section 5b. You can get always get rid of the limit by agreeing to pay a 5€ storage reactivation fee after removing ALL files that are not connected to a Minecraft server.
5.b) All services provided by Germanode may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any German federal, state or city law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, material for promoting terrorism or material protected by trade secret and other statutes. The user agrees to indemnify and hold harmless Germanode from any claims resulting from the use of service which damages the user or any other party.
Examples of unacceptable content:
- Pirated software, files or plugins,
- Hacker programs or archives,
- Warez files,
- Pornography, etc.
NOTICE: If your account is found to contain ILLEGAL activity, illegal mp3 files, pirated software, hacker programs, warez programs, or any other illegal or forbidden files, your account will be terminated immediately, without notice, and a 50€ cancellation fee will apply. Additionally, Germanode will notify the proper authorities of your actions.
NOTICE: If any of your backups contain illegal activity, Germanode staff can and will reject the file recovery request.
Germanode reserves the right to have our physical servers down for scheduled maintenance 5 hours a month. Germanode reserves the right to have our physical servers down for unscheduled emergency maintenance 48 hours a month. In the event of significant data loss or hardware failure, Germanode reserves the right to have our physical servers down for up to 96 hours in the period of a month. Significant data loss refers to loss of data that would render our server(s) and/or services unable to properly function in the way that they should. Germanode is not responsible for your individual game server(s) downtime but will work with you through the game server control panel on our web site to resolve the problem. We reserve the right to discontinue support for that particular problem if we are unable to resolve it.
We also reserve a right to shut your server down or suspend it at any time if your server is experiencing a larger DDoS attacks on a regular basis.
7) Additional Fees
Certain services carry a setup fee charged by Germanode to client, which must be paid by client in order to have use of said services. If client terminates this agreement, client shall be responsible for any and all outstanding fees owed to Germanode and agrees to pay any and all fees incurred by client. Because the services are provided on a monthly basis, the client will be responsible for service fees incurred each month, regardless of when the client provides notice of termination. Thus, for example, if the client provides notice of termination on the 15th day of a particular month, the client will be responsible for service fees for the entire month, and such fees will not be pro-rated or refunded.
Any service that deactivated due to non-payment will require a reactivation fee of 10€ prior to reactivation. Services will be terminated 5 days after the due date and all access rights will be revoked at the end of the 5th day. Customer files will be stored for the period of 90 days after deactivation – during this period, reactivation is possible (10€ fee).
After the deactivation, all access rights to our services are revoked and there is no possibility to access the files by the customer unless the customer agrees to pay a 4.99€ storage activation fee. In that case, Germanode will provide the customer with a .zip file containing his/her files.
8) Limitation of Liability
Germanode shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Germanodes’ servers going off-line or being unavailable for any reason whatsoever. Furthermore, Germanode shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any files from one of Germanodes ‘ servers. All damages shall be limited to the immediate termination of service.
Germanode cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Certain services provided by Germanode are resold. Thus, certain equipment, routing, software and programming used by Germanode are not directly owned or written by Germanode. Moreover, Germanode holds no responsibility for the use of our clients’ accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as Germanode sees fit.
9) Terms & Conditions and Pricing
We reserve the right to change our plan’s prices at any time without further notice. However, if you have ordered but not yet paid for a product, we guarantee the price for one month from when the order was placed.
We reserve the right to change Terms & Conditions at any time without further notice. In case you disagree with new Terms & Conditions, you have a right to cancel your plan within 30 days since the Terms & Conditions update.
10) Customer Data (General Data Protection Regulation – GDPR)
By registering and agreeing to our terms, we reserve a right to store and process and encrypt the data you provide when you register to our site. The types of data we store and process are: Name, Surname, Address, Email, Phone number, Type of payment, PayPal address, Type of order and cryptocurrency address.
This data is only used for the following purposes:
- Creating statistics and demographics of customers orders to better understand the needs of customers.
- Managing servers when a customer requires support or ordering additional services.
- Preventing possible unauthorised PayPal payments.
- Inform customers about Germanode news via e-mail
The data is NEVER sold to advertisers or given in any shape or form to any third party person or a company.
A customer can always send us a request via email [email protected] to have his data erased completely from our servers within the 72 hours of the request.
If a customer wishes to receive a full list of data we store for his account, he can always email us and will receive a full list within 72 hours of the request.
By using our services, customers that already agreed to our old Terms & Conditions before May 2018, agree to these Terms & Conditions. If a customer does not agree with the new terms, he may request data removal.
The data that we do not access are customer files unless given a written consent of the customer or in case we suspect the files on a customers server could be harmful towards our services or illegal.
